Simpson Thacher Wins Appeal in Hilton ERISA Class Action Litigation

On February 15, the U.S. Court of Appeals for the District of Columbia Circuit affirmed entry of final judgment in an ERISA class action lawsuit against Hilton and the Hilton Hotels Retirement Plan which was filed over 20 years ago. The District Court had concluded its jurisdiction and entered final judgment in December 2015, finding Hilton in compliance with its remedial orders governing past ERISA violations. On appeal, the Court of Appeals affirmed, rejecting Plaintiff’s request for a post-judgment equitable accounting and holding that the District Court did not abuse its discretion in ending its active supervision of Hilton’s compliance with the judgment, having found no systemic problems or failures in Hilton’s implementation of its rulings.
