In their column in the New York Law Journal, Litigation Partners Bill Russell and Linton Mann III explore the recent Court of Appeals decision in which it overturned the criminal conviction of Hollywood producer Harvey Weinstein. The 4-3 majority opinion reversed a unanimous decision of the Appellate Division, First Department that had affirmed Weinstein’s conviction. There were two strongly worded dissents by Judges Singas and Cannataro, arguing that the trial court’s discretionary rulings on the prosecution’s Molineux and Sandoval applications should not be disturbed on appeal.
