Buzz Frahn Quoted in Daily Journal on Proposed Legislation to Allow Factual Innocence Finding Without Retrial in California

02.23.21

Litigation Partner Buzz Frahn was quoted in a Daily Journal article titled, “Bill aims to allow factual innocence finding without retrial.” The article analyzed the recently proposed legislation in California which would allow a wrongfully convicted person seeking a finding of factual innocence to show that a reasonable jury would not find them guilty based on the evidence that exonerated them. “The proposed standard makes more sense, because it recognizes the presumption of innocence, unlike the current process,” Buzz noted.

In January 2021, Buzz led the Simpson Thacher team that, alongside the North California Innocence Project (NCIP), secured an order from the Sacramento County Superior Court of California declaring client Jeremy Puckett factually innocent of the murder for which he had been wrongfully convicted and incarcerated for 18 years.
