Simpson Thacher and Catholic Migration Services Win Appellate Victory in Rent Overcharge Case

On June 17, 2020, the New York Supreme Court, Appellate Division, Second Department unanimously reversed decisions of the Queens County Supreme Court, which granted summary judgment against the Firm’s clients, a disabled woman and her son, whose landlord illegally overcharged them rent for more than a decade. Catholic Migration Services brought overcharge actions in 2016 to recover the more than 4x rent charged in violation of a rent reduction order of the Division of Housing and Community Renewal (DHCR). The Supreme Court granted summary judgment and dismissed the overcharge actions. Simpson Thacher briefed the appeal to the Second Department, which reversed the grants of summary judgment and sent the parallel cases back to the Supreme Court for trial.
