Allison Bernbach Quoted in Hedge Fund Law Report on Avoiding Conflicts of Interest

Allison Bernbach was quoted in part three of a three-part series of articles for the Hedge Fund Law Report titled, “Navigating the SEC’s Interpretation Regarding an Investment Adviser’s Standard of Conduct: Six Tools to Systematically Identify Conflicts of Interest (Part Three of Three),” which examines the practical implications of the SEC’s Interpretation Regarding Standard of Conduct for Investment Advisers (Interpretation) for private fund managers and offers best practices for investment advisers to avoid and manage potential conflicts of interest. In the article, Allison noted that, among other tactics, advisers should take special care when drafting their conflicts policy, saying, “a well-drafted conflicts policy should provide clear mechanisms for identifying, reporting, mitigating and disclosing conflicts, but it should also be flexible and conceptually broad enough to address new conflicts as they arise.”
