Litigation Partner Noah Leibowitz was quoted in a Law360 article, “Imation Must Pay $11M In Flash Drive Patent Suit.” The article discusses the verdict of a Delaware federal jury, which found after a five-day trial that 25 of Imation Corp.’s “IronKey” secure USB flash drive and hard drive product lines infringed IOENGINE LLC’s patent, and awarded $11 million in damages. In a separate jury trial on January 13, 2017, another Delaware jury found the same patent valid and infringed by Interactive Media Corp. d/b/a Kanguru Solutions, which sells secure USB storage devices under the “Defender” brand. Noah, who led the trial team, commented that “IOENGINE is very happy that the jury came back the way it did” and noted that “[t]wo separate juries in a span of six weeks have now found the '047 patent valid and infringed, and have credited IOENGINE’s founder as the sole inventor of the patented technology.”
The Simpson Thacher trial team included Noah M. Leibowitz, Greg T. Chuebon and Michael H. Joshi.
