In 2008, several class action suits were filed against LifeLock, a company that provides identity theft protection services. The suits alleged that LifeLock engaged in fraudulent and deceptive activities to induce customers to purchase its services. LifeLock sought insurance coverage for the suits from Certain Underwriters at Lloyd’s London under an errors and omissions policy, which the insurer denied. In 2015, Lifelock sued Underwriters for coverage in New York Supreme Court. On November 19, 2015, Justice Shirley Werner Kornreich granted Underwriters’ motion to dismiss the case from the bench, declaring that coverage for the class actions is not covered by the policy. Bryce L. Friedman argued the motion and the Simpson Thacher team includes Summer Craig and Jamie Fell.
