Simpson Thacher Wins Summary Judgment For Travelers

In a 70-page decision issued publicly on November 13, 2013, the Honorable Katherine B. Forrest of the U.S. District Court for the Southern District of New York granted two summary judgment motions the Firm filed on behalf of Travelers in a dispute concerning Northrop Grumman’s claims for coverage for environmental clean-up costs.  The ruling finds that Travelers has no obligation to provide coverage for liabilities arising from Northrop Grumman’s Calverton, Long Island Facility because Northrop Grumman failed to provide timely notice of potential claims at the Facility.  The decision also awards summary judgment as to Northrop Grumman’s claims for coverage relating to its Bethpage, New York Facility under two Environmental Hazard Policies.
