Simpson Thacher litigation partner Peter Kazanoff will speak on a panel at Practising Law Institute’s “M&A Litigation 2012” program on June 28, 2012 in New York City. The panel entitled "Tackling Procedure: Corporate Benefit Fee Awards and the Motion to Expedite" will discuss predicting, awarding, timing and allocating corporate benefit fee awards including: if fee awards can be predicted; the right methodology for valuing corporate benefits; if the courts should enter interim fee awards; and who deserves the fee when multiple sets of plaintiffs claim to have achieved the results. The panel will also cover mastering the motion to expedite in the Court of Chancery including: why the first hurdle can be the most important; conflicting notions of irreparable harm; and the impact of motion to expedite practice on multi-forum litigation.
