Simpson Thacher Wins Summary Judgment For Insurers

On February 21, 2012, the Milwaukee County Circuit Court awarded partial summary judgment to Firm clients AIU Insurance Company, Lexington Insurance Company and National Union Fire Insurance Company of Pittsburgh, PA in litigation brought by The Coca-Cola Company and Cleaver Brooks, Inc.  The court dismissed Coke and Cleaver Brooks’ claims that a purported contract was enforceable because, among other things, evidence of plaintiffs’ conduct discovered by the Firm was inconsistent with the existence of an enforceable agreement.  The court also denied Coke and Cleaver Brooks’ partial summary judgment motion seeking to enforce a term sheet by contract or estoppel.
