Firm Achieves Third Appellate Victory for Heineken

On October 4, 2007, the Colorado Court of Appeals affirmed the district court dismissal of a class action against Heineken and other alcohol beverage companies, and granted defendants' request for attorneys fees. The case alleged that Heineken, represented by Simpson Thacher, and the other companies "targeted" underage youth with mass media alcohol advertising. This victory followed on the heels of the Firm's obtaining a decision from the D.C. Court of Appeals on June 27, 2007 dismissing the first of the alcohol advertising class actions brought against leading alcohol beverage manufacturers and importers, and a decision by the United States Court of Appeals for the Sixth Circuit on July 17, 2007 which, in a consolidated appeal from dismissals in district courts in Ohio and Michigan, directed the lower courts to dismiss the two class actions.
