Vanessa Burrows Quoted in Bloomberg Law on SCOTUS Chevron Decision Impact on FDA Rulemaking

Healthcare Partner Vanessa Burrows was quoted in a Bloomberg Law article titled, “FDA Drug Approvals, Rulemaking Are Tested After Chevron Decision,” which discussed the implications of the U.S. Supreme Court decision overruling the Chevron deference on FDA actions and rulemaking. Vanessa explained that the FDA’s science-based and technical determinations are expected to be leveraged in challenges moving forward. She noted, “I anticipate that FDA will continue to rely on the experience of its scientists and other experts when promulgating regulations that interpret particular statutory provisions and that the agency will provide robust justifications for changes that are inconsistent with earlier pronouncements.”
