Simpson Thacher Obtains Appellate Reversal Dismissing Florida Lawsuit

On August 11, the Florida Court of Appeals issued a unanimous decision in favor of Simpson Thacher client Stonepeak Infrastructure Partners LP, holding that Stonepeak was not subject to personal jurisdiction in a Florida lawsuit brought by Tall Tower Capital, LLC seeking to allege breach of contract and fiduciary duty claims arising out of the parties’ participation in an auction conducted by Clear Channel to sell broadcast towers located throughout the country. In a 16-page opinion, the Florida Court of Appeals reversed the trial court’s determination that Stonepeak was subject to jurisdiction in Florida, holding that Stonepeak was not in a fiduciary relationship with Tall Tower and otherwise lacked sufficient contacts with Florida to support the exercise of jurisdiction.
