Simpson Thacher Wins Over $500 Million for Daiichi Sankyo in Arbitration

Simpson Thacher prevailed in an international arbitration on behalf of long-time client, Daiichi Sankyo, a leading Japanese pharmaceutical company, against the former owners of Indian generic pharmaceutical company Ranbaxy. The final arbitral award was issued last week and awarded Daiichi Sankyo the rupee-denominated equivalent of approximately US$525 million, including attorneys’ fees and expenses, pre-award interest and reimbursement of arbitration costs.

The dispute arose in connection with Daiichi Sankyo’s 2008 investment in Ranbaxy. Daiichi Sankyo initiated an arbitral claim for damages resulting from the Ranbaxy sellers’ fraudulent concealment and misrepresentations regarding certain critical information concerning U.S. Food and Drug Administration and Department of Justice investigations into Ranbaxy.
